  • Acquisitions and disposals of commercial office buildings, including large-scale purchases of CBD and Fringe CBD office building assets on behalf of listed property trusts

  • Acquisition and disposal of retail shopping centres including large centres anchored by multinational tenants and smaller-scale regional-based convenience centres

  • Acquisition and disposal of bulky goods centres and large-format retail centres

  • Acquisition and disposal of industrial and manufacturing facilities, as well as standalone industrial sheds and logistics warehouses

  • Acquisition and disposal of hotels, as well as licensed pubs and regional venues

 

Leasing
– Commercial, Industrial and Retail

We regularly advise our clients in relation to co-ordinating leasing campaigns through to negotiating commercial, industrial and retail leases and subleases. 

 

We act for developers and landlords of both large and small retail shopping centres as well as industrial facilities and commercial premises. We also act for a range of tenants from sole traders through to high-profile national companies.   

We assist our clients with:

  • Drafting and negotiating commercial and industrial leases and subleases

  • Drafting and negotiating retail leases including managing compliance with all statutory disclosure requirements under the Retail Shop Leases Act

  • Negotiating variations of lease terms

  • Negotiating exercise of options and extensions to renew leases

  • Engaging in enforcement and recovery action against tenants

  • Facilitating lease assignment and sub-leasing arrangements

 

Development & Body Corporate

We work with our clients to establish the right structures for residential, commercial, retail and mixed-use property developments. 

 

We have significant experience in flat land subdivision as well as single-stage and multi-stage community title development structures. 

We provide advice at all stages from initial site acquisition and settlement right through to scheme establishment and settlement of off the plan sale contracts. 

Our expertise in development law enables us to advise on: 

  • Residential apartment and townhouse community title scheme developments, including high-rise strata buildings and sale of proposed lots off the plan

  • Commercial office park developments (both strata title and non-CTS), including both the sale and leasing of proposed lots

  • Residential flat land subdivision, including base parcel reconfiguration and staging of greenfield sites

  • Mixed-use strata title developments with a combination of retail, commercial and residential schemes

  • Layered body corporate scheme arrangements and management rights acquisitions and sales

  • Self-managed superannuation fund arrangements for property development and investment

 

Project Structuring

We have significant experience in formulating structures, in conjunction with other key consultants such as accountants, to facilitate both property investment and development across residential and commercial asset classes. 

 

The overarching aim when it comes to structuring is to mitigate risk whilst at the same time managing indirect and direct transactional taxes.

We provide services to our clients as follows: 

  • Negotiation of joint venture agreements and fund through sale structures

  • Loan agreement and real property mortgage documentation

  • Development management agreements with profit share or end takeout

  • Transactional tax advice including stamp duty and GST implications

  • Syndication and trust structuring arrangements for property development

 

Investor Acquisitions

Our Conveyancing Managers have significant experience in acting for investors in relation to off the plan purchases of units and townhouses across metropolitan Queensland.
